'Article 6 of the European Convention on Human Rights does not apply to public sector ombudsmen,
Mr. Osmotherly believes. In his view, because private ombudsmen make binding decisions, Article 6 may
apply to them.Since public sector ombudsmen do not make binding decisions, it does not apply to them.
But he admitted that they could get a nasty shock in a few years when Article 6 takes effect nationally
through a British law.'

Our view

Public Service Ombudsman's decisions may not be binding on Local Authorities (they are free to ignore
the Ombudsman) but they are binding on the complainant because a complainant has no right of appeal. As a
result article 6 must apply to Public Sector Ombudsmen as far as complainants are concerned.

Another quote from Osmotherly

'Mr. Osmotherly explained that agencies don't just roll over and accept recommendations. Often there must be
explanation and discussion before a recommendation is accepted.'


Our View

What Mr Osmotherly means is that they have to suck up to Local Authorities because their decisions are not mandatory.
They are a load of Toothless tigers sucking up to Local Authorities just in case the Local Authority doesn't like their
recommendation.
