Petition number one is now up and running (ends 10th October 2007). What we need to do now is start developing more petitions so they can quickly follow on from the first one. (Or even run concurrently?) Obviously some of them will have to take into account the Government's response to the first petition but that doesn't stop us making preparations.

Some of the issues that we could address in additional petitions are, Please add your thoughts to the list below.

  1. No ex authority staff to hold a senior position within the Local Government Ombudsman's office.
  2. Local settlements to be agreed between all parties.
  3. When maladministration is found it should be reported as such even if the case is settled.
  4. All evidence and documentation to be made available to both parties.
  5. The rules of natural justice need to be observed.
  6. Findings of the Local Government Ombudsman should be open to a proper appeal and not limited to a judicial review.
  7. All remedies should be legally enforceable.
  8. Punitive damages should be available for serious offences.
  9. Local Authority Legal Advisers to owe duty of care to both Ombudsman and complainant.
  10. Local Authority to be required to carry insurance for its legal advisers and not self insure.
  11. Ombudsman to be required to identify officer negligence and/or misfeasance as forming part of maladministration and to provide route to compensation.
  12. Review of adoption of European Convention of Human Rights by both Local Government Ombudsman and Local Authorities to be initiated by Human Rights Commission (to be formed for England and Wales Oct 2007). Performance Indicator to be included in Audit Commission 'tool kit'.
  13. Determination if Secretary of State and Local Government meet their ECHR Article 13 Obligations due to existence of Local Government Ombudsman.
  14. Head of Paid Service as defined by LGHA, 1989 to be made personally responsible for all decisions reached by a local authority based on provision of flawed legal advice by a local authority solicitor (contract and/or direct employee) and for all findings of maladministration and/or local settlements.
  15. Removal of MP filter to Parliamentary Ombudsman - to identify that elected politicians do not control the executive, and bring national government into line with local government.
  16. Mrs T to be nominated for an honour for bringing the issues raised by the Local Government Ombudsman to the attention of Downing Street.
